Description

The paper discusses the formation and development of international commercial mediation through analysis of birth of modern mediation in the US and its spread into common law jurisdictions: Australia, England and Wales, Singapore and Hong Kong. The paper concludes that Harvard Negotiation Project and CEDR (Centre for Effective Dispute Resolution) in England have impacted the formation and development of international commercial mediation, with emphasis on self-determination.
