Abstract

パンデミック下、特許権は医薬品供給の障害となるのか?多数プレイヤーの関与により生じる「アンチコモンズの悲劇」問題に取り組む。

医薬品の開発供給には、知的財産の利用が不可欠である。開発供給に必要な要素につき、許諾権限を持つ者の同意が得られなければ、治療薬やワクチンの開発は妨げられてしまう。拒否権限を持つ者が複数存在するゆえに生じる、「アンチコモンズの悲劇」だ。平時とは異なる緊急時の様々な法的問題について、解決の選択肢とその展望を見通す。

During a pandemic, will patent rights become an obstacle to the supply of medicines? This program tackles the "tragedy of the anticommons" problem that arises when multiple players are involved.

The use of intellectual property is essential for the development and supply of medicines. Without the consent of those with licensing authority for the elements necessary for development and supply, the development of treatments and vaccines will be hindered. This "tragedy of the anticommons" arises because multiple parties have veto power. This program explores the various legal issues that arise during emergencies, which differ from normal times, and provides a look at options and prospects for solving them.
