Abstract
This chapter focuses on the current international legal framework of global health cooperation for the surveillance, prevention, and control of pandemic disease (hereafter, ‘pandemic cooperation’). Due to space constraints, it does not cover all applicable, or potentially applicable, international legal frameworks. Instead, it focuses on the duty of States and the World Health Organization (‘WHO’) to cooperate under the International Health Regulations (‘IHR’ or ‘Regulations’). These Regulations are the primary, internationally binding, legal instrument governing States’ response to pandemic events. This chapter considers the challenges of such cooperation and the renewed efforts at the WHO level to revise the international legal framework for pandemic response by drawing lessons from the COVID-19 pandemic.
