Abstract

In the first of two articles, the author discusses the recent decision of the Sheriff Appeal Court in Kane (Graham) v PF, Kilmarnock [2024] SAC (Crim) 7; 2024 S.L.T. (SAC) 137 in which the court provided guidance on the correct mode of appeal in
circumstances where an order for absolute discharge is sought, and further developed the sentencing jurisprudence on this method of disposal.
