In the second of two articles on the decision of the Sheriff Appeal Court in Kane
(Graham) v PF, Kilmarnock [2024] SAC (Crim) 7; 2024 S.L.T. (SAC) 137, the author
examines the provisions, and relevant case law, on granting a discharge in England & Wales and New Zealand and considers the lessons which the Scottish courts can learn from practice in these jurisdictions.
