Abstract
The reforms being introduced by the Moveable Transactions (Scotland) Act 2023, including the arrival of the statutory pledge, should be widely welcomed. However, as if with any substantial reform, there are various challenges arising from the legislation. This article examines a selection of such challenges in relation to property classes and descriptions, as well as limitations regarding security providers and permitted assets. It then explores some of the likely consequences and issues that will affect the statutory pledge in the context of ranking against other competing rights.
