Abstract

Scotland Gas Networks PLC v QBE UK Ltd is the first to consider the scope of section 1(4) of the Third Parties (Rights Against Insurers Act) 2010 (“the 2010 Act”). The court found that a decree in default, issued due to the failure of an insolvent insured to appear at a procedural hearing, is sufficient to establish the insurer's liability under the 2010 Act.
