Abstract

Comments on the Sheriff Appeal Court decision in T (K) v Procurator Fiscal, Falkirk, an appeal against conviction and sentence for contravening the Sexual Offences (Scotland) Act 2009 s.9, where the appellant observed and photographed his partner while she was asleep. Compares the law in England and Wales on the same offence.
