Abstract

In the first in a series of four articles on HM Advocate v MG [2023] HCJAC 3; 2023 J.C. 68; 2023 S.L.T. 232; 2023 S.C.C.R. 97, the author considers the decision in which the Crown unsuccessfully appealed against the sentence of four years’ imprisonment imposed on the respondent following his conviction, after trial, of raping an intoxicated 19 year old woman.
