Abstract
The political will documented in the coalition agreement between the CDU, CSU and SPD to include children's rights in the Basic Law is an occasion to ascertain the status quo of the protection of children's rights and needs in the light of child development. What about the right to be born? What needs are there in early childhood, what are the rights of students? An analysis of the applicable law that answers these questions forms the basis for clarifying the requirements as well as the opportunities and risks of the envisaged constitutional amendment: If the Basic Law has gaps in protection, which make the constitutional standardization of a child's fundamental right necessary? How would its introduction affect parental rights? And what are the consequences of the guarantees of children's rights on an international and supranational level? - This anthology examines these and other questions. The essays included in it arose from lectures that were held in the law and political science section of the Görres Society at its general assembly in Bamberg in autumn 2018.
