Abstract

Examines Sorrell (Barry) v Procurator Fiscal, Greenock (SAC), a successful appeal against the certification of an offence of disclosing an intimate photograph, contrary to the Abusive Behaviour and Sexual Harm (Scotland) Act 2016 s.2(1), under the Sexual Offences Act 2003 s.92(2), where neither the offence nor the motivation for the offending involved a significant sexual element.
