Abstract

In Republic of Mozambique (acting through its Attorney General) v Credit Suisse International and others [2023] EWHC 2215 (Comm), the Commercial Court held that a foreign head of state benefits from sovereign immunity in respect of litigation concerning commercial activities undertaken outside the UK. This follows from the commercial exception to sovereign immunity in Article 31(1) of the Vienna Convention on Diplomatic Relations as incorporated into UK law by the Diplomatic Privileges Act 1964 (DPA).
