Abstract

Provides an overview of the English sentencing guidelines on causing death by dangerous driving and discusses their use in HM Advocate v Gatti (Shaun) (HCJ Appeal) and HM Advocate v Jones (Stephen) (HCJ Appeal) in which the Crown unsuccessfully challenged, on grounds of undue leniency, sentences imposed following guilty pleas to causing death by dangerous driving. Comments on the use of sentencing guidelines in Scotland, England and Wales.
