The Role of Arbitral Tribunals in Resolving Energy and Natural Resources Disputes in Africa

Abstract

The role of arbitral tribunals has not received the desired attention of scholars and commentators in connection with energy and natural resources (ENR) disputes in Africa. The topic is nuanced for two reasons, which are addressed in this chapter. One is the peculiarities of ENR disputes, and the other is the prevailing circumstances of the ENR sector in Africa. On the first point, ENR disputes often involve significant amounts and highly technical subjects. Because arbitration is significantly used in the sector, a question arises as to how arbitration enhances the sector. A relevant point is also the contributions of ENR disputes to the development of best practices in international arbitration. On the second point, it is unarguable that Africa needs economic developments, of which the ENR sector is a key factor. Consequently, the role of arbitral tribunals in this regard requires serious consideration. This chapter considers the topic from the standpoints of the parties to ENR disputes and the broader implications of the decisions of the tribunals on the development of a legal framework that fulfills the peculiar needs of the ENR sector in Africa.
