Abstract

Reviews A (R) v HM Advocate (HCJ Appeal) on the application of the sentencing guidance set out in Gill v Thomson (HCJ) for benefit fraud. Considers whether this guidance should be updated in light of current English sentencing guidelines on benefit fraud which take an algorithmic approach.
