Vận dụng phương pháp so sánh trong nghiên cứu khoa học pháp lý- một số vấn đề cần suy ngẫm: Applying comparative methods in legal scientific research - some issues to ponder

Besides the analysis method, synthesis method, survey method and modelling method, comparison is
considered as an important method in legal scientific research. Comparison in legal scientific research is commonly
understood to find out similarities and differences among legal norms or the legal systems. Nevertheless,
comparison should not be limited in provisions or regulations, but it should be extended to other factors
affecting the legal system such as economy, politics, society, ideology etc... to find a common denominator. The
development of nations and deep international integration are the reasons why comparative law is developing
in present. In this paper, the authors will discuss some issues related to the application of comparison method in
legal scientific research.

Bên cạnh phương pháp phân tích, phương pháp tổng hợp, phương pháp khảo sát và phương pháp mô hình hóa, so sánh được coi là một phương pháp quan trọng trong nghiên cứu khoa học pháp lý. Tuy nhiên, việc so sánh không nên chỉ giới hạn trong các điều khoản, quy định mà nên mở rộng ra các yếu tố khác tác động đến hệ thống pháp luật như kinh tế, chính trị, xã hội, tư tưởng ... để tìm ra mẫu số chung. Sự phát triển của các quốc gia và sự hội nhập quốc tế sâu rộng là lý do khiến luật so sánh ngày càng phát triển như hiện nay. Trong bài báo này, nhóm tác giả sẽ thảo luận một số vấn đề liên quan đến việc áp dụng phương pháp so sánh trong nghiên cứu khoa học pháp lý.
